I found this surprising vote of sanity coming from France. The \"Cap and Tax\" law in France was overturned by the Constitutional court of France. The original text is in Swiss standard German is appended; I have translated it.

Setback for Sarkozy

French Consitutional court \"tip over\' the Carbon dioxide duty.

The CO2 duty on fossil fuels that in France on January should have stepped into effect was declared invalid by the Constitutional court.  This means a severe set back for President Sarkozy.

The French constitutional ruling came after a detailed review to the end (close) that the climate tax effective 1 January basically on the consumption of fossil energy source (crude oil, gas, coal) would be contradict the Constitution and would be inefficient as well as unjust. With their judgment, the \"nine wise men\" of the Constitutional Counsel mean a good [legal] complaint.

Frankreichs Verfassungsrichter kippen die Kohlendioxidabgabe

Die CO 2 -Abgabe auf fossilen Brennstoffen, die in Frankreich am 1. Januar hätte in Kraft treten sollen, ist vom Verfassungsgericht fungltig erklrt worden. Dies bedeutet einen schwerenckschlag. PrEsident Sarkozy.

Der franz sische Verfassungsrat ist nach einer eingehenden Ãœberp fung zum Schluss gekommen, dass die Klimasteuer, die ab 1. Januar grunds tzlich auf dem Verbrauch fossiler Energietr ger (Erd, Gas, Kohle)  tte erhoben werden sollen, im Widerspruch zum Grundgesetz stehe und daRber hinaus in ihren Anwendungsbestimmungen ebenso ineffizient wie ungerecht sei. Mit ihrem Urteil hiessen die «neun Weisen» des Conseil constitutionnel eine Klage der Opposition gut.
