Judge Christopher C. Conner got it right!  Tuesday, in

      one of more than thirty lawsuits against ObamaCare

      making their way through the federal judiciary, the

      Harrisburg, Pennsylvania, judge held ObamaCare's

      "individual mandate" to be  unconstitutional.

      Right now, my legal staff is preparing Liberty Counsel's

      appeal of our ruling from the Fourth Circuit Court

      of Appeals on our case, Liberty University v. Geithner,

      for hearing at the United States Supreme Court.  We

      have entered the most important phase of our multi-year

      battle to stop ObamaCare!   Please take a minute to

In his ruling earlier this week against ObamaCare, Judge

Christopher C. Conner was right on point... 

      "The federal government, however, is one of limited

      enumerated powers," he wrote, "and Congress's efforts

      to remedy the ailing health care and health insurance

      markets must fit squarely within the boundaries of

      those powers."

Judge Conner held that the power to regulate interstate

commerce does NOT include the power to dictate a lifetime

of buying health insurance!  I couldn't agree more, and

that simple fact is at the heart of Liberty Counsel's own

lawsuit against ObamaCare.

The government does NOT have the right to force people to

buy coverage under the President's healthcare "reform" law.

The individual mandate is a radical departure from the

foundation and the intent of our Constitution - and from

the views of the framers who drafted it. 

++ObamaCare's final battleground will be the Supreme Court.

As I've shared with you recently, the Fourth Circuit Court

of Appeals issued a 2-1 adverse ruling regarding our case

against ObamaCare.

This ruling is all over the place! One judge on the 3-judge

panel would uphold ObamaCare under the government's power

to tax, although 10 judges have thus far said the individual

mandate is a "penalty," not a "tax."

Another of the three judges would uphold ObamaCare under

the Commerce Clause, saying the government can force law-

abiding citizens to purchase anything it deems appropriate.

If this appellate court's logic prevails, you and I will

be forced to live under ObamaCare's unconstitutional mandate!

      But, thankfully, this ruling is only the next step

      on the path to the final round at the U.S. Supreme

      Court.  The two judges appointed by Barack Obama

      and one by Bill Clinton will NOT have the final

      say on ObamaCare!

Our appeal will be filed with the U.S. Supreme Court in

the next few weeks. I believe later this year, before the

end of December, we'll have word from the High Court about

taking these cases. I feel certain that the court will

schedule arguments in the early part of 2012, and by the end

of June we will have a ruling on the constitutionality of

ObamaCare.

Here is the hopeful side of our situation...

      U.S. Supreme Court and the first to strike a

      legal death blow against the heinous ObamaCare

      law.

      legal precedent on our side to have our case

      heard and to achieve a sweeping rejection of

      this court-ordered acceptance of ObamaCare's

      unconstitutional mandate.  This latest decision

      from Judge Conner in Pennsylvania affirms the

      facts at the heart of Liberty Counsel's case

      against the outrageous government takeover of

      our medical services system!
