I testified at the hearing today on it.  The Chair of the committee and I exchanged very heated words. Very tense hearing and  I called them out on what they tried to do and did not mince words.
 
The lobbyist for the Georgia Baptist Association testified that it would prevent pastors from representing churches in talking to legislators. They agreed to amend it. We are meeting tomorrow to disciss the language we want. They were scrambling to do damage control all day because we shed light on what they were doing. Speaker Ralston is livid because we noticed the provision and were able to moblize  and defeat the provision in 24 hours.  We posted the info on FaceBook and google groups and it went viral. Activists started making phone calls and sending emails to the legislators. We notifed churches, homeowners associations and any group we felt may be effected. We The people win another one because we took action and were able to mobilize quickly..
They thought because it was part of a comprehensive package, we would not notice that provison and all the attention wold be paid to the total banning of lobbyist gifts. We were awake and paid attention. Now they are scrambling to do damage control.  We mobilized groups on the left and right to fight it. Always pay attention and remember what Reagan said - Trust but verifiy..
 
Lobbyists for the Chambers of Commerce and  other powerful lobbying organziations were pushing for it to diminish citizen activisim.
 
Until we came on the scene the Chamber lobbyists ruled the Capitol and got legislation passed they wanted. Since "We the people" took back our house the past few years, things have changed dramatically. We developed alliances with left leaning groups on issues we agreed on and were able to kill legislation the chamber lobbyists wanted. We did not have their money so we had to think outside the box and we did this by forming alliances with groups like Common Cause.
 
Had we not paid attention, the lobbyist provision would have passed and this would have been the result:
 
State Sen. Josh McKoon analyzed the ramifications of the expanded lobbyist definitions in the Ralston Ethics Bill (HB 142)introduced in the House yesterday.



The definition of lobbyist in this bill will have ramifications for all of us. Sen. Josh McKoon analyzed the lobbyist portion and this is what he found:

The circumstances below would require people to pay the $ 320 lobbyist registration fee and register as lobbyists and it does not just effect going to the Capitol and legislators. It extends to the local level.:


A citizen who comes to the Capitol to speak to a Senator or Representative that they are not an elector for;

A citizen who e-mails or otherwise contacts a Senator or Representative that they are not an elector for;

A citizen who urges fellow citizens to contact Senators or Representatives on an issue if that request is not limited to Senators or Representatives that citizen is allowed to vote for;

A citizen who appears before a City Council, County Commission or Board of Education if they do not vote for every member of such a body;

A citizen who is not specifically invited to speak to a Committee of the General Assembly but signs up to offer their views;

A citizen who appears at a rally and generally advocates for or against an issue;

A citizen who establishes a Facebook page or other social media presence in favor or opposed to a given issue;

A citizen who writes a letter to the editor to their local newspaper on a given issue.

Every member of every editorial board in the state;

Every member of any group coming to the Capitol to influence legislation beyond the local delegation (ie: a realtor from Savannah stopped me yesterday to discuss legislation. That would be outlawed under this bill).

Just to sum up this covers any action taken that could be "influencing the decision making of a public officer". So not limited to advocacy on a bill. Not limited to members of the General Assembly.

Georgia's Speaker of the House, David Ralston, has introduced an piece of unconstitutional legislation and is strong arming, if not threatening, the House leadership for endorsement.
 
HB 142 would effectively prohibit private citizens from any contact with any elected official, state or local level, other than one's specific elected official in one's specific district, unless the citizen is a fee paying, report generating, registered lobbyist.
 
 
 
This bill was introduced on Tuesday of this week, placed in Rules Committee On Wednesday and is being rushed to the House floor for a vote this week!   This speed serves to shut down opposition before it starts and to stop private citizens from expressing their opinion to legislators about proposed legislation this session and beyond.
 
This bill would even shut down private newsletters about the happenings at the Capitol!
 
This is clearly a backlash or retaliation piece against the grassroots folks who are pushing for better ethics in government.
 
Amongst other equally onerous bills, Anti-gun and Obamacare legislation have been introduced for this session.  HB142 would prohibit private citizens from participating in any committee hearings or contacting committee members to express their opinion on the bills.
