DID YOU KNOW?

Good Evening.

Unknown to most, our government and most other governments have more than one set of books known as " Comprehensive Account Financial Report " or CAFR. These are the account ledgers that hold the real assets and balances of a country . Please read further below.

Each year all State and local governments prepare a financial report on assets, liabilities, revenues and expenditures in more or less i a standardized format that must conform to the Government Accounting Standards Board (GASB) accounting and financial reporting standards. This financial report is called the Comprehensive Annual Financial Report (CAFR, pronounced "cay-fer"). Most people have heard of the budget, which is the document that plans and authorizes the spending of money. The CAFR describes what actually was spent and the status of assets and liabilities at the end of the fiscal year.

The CAFR:

Presents a comprehensive picture of a government's financial condition by combining the annual financial reports of all government agencies and universities.

Provides information on all government funds including those held outside the government treasury.

Presents information on the accrual basis recognizing amounts owed by the government but not paid at the end of the fiscal year, as well as amounts due to the government but not received by the end of the fiscal year.

Contains information on real property and other fixed assets, long-term obligations or investments held outside the government treasury; and includes statistical and some economic data.

Comprehensive Annual Financial Reports provide information which is used by investment companies such as Moody's Investors Services and Standard and Poor's Corporation to determine the state's fiscal integrity and set bond rates. It includes a comprehensive presentation of the state's financial and operating activities.

What are Surpluses?

Government operations, except for retirement/pension funds, should be on a pay-as-you-go system. Governments should be nonprofit organizations. Government surpluses, as used in this site, are funds that are not required or needed for the operation of all government operations, funds, accounts, agencies, etc., directly or indirectly, for the year(s) covered by the budget which is usually one to two years.

How Were the Surpluses Created?

There are two major ways that these surpluses are created, although there are other "creative accounting" techniques that are used. 

The first way is to take in more revenue than expenditures; that is the government made a profit. 

Many States changed the laws/Constitution that allowed them to hold excesses of the taxpayers money. The original laws in being for over a 100 years stated that all excess funds, either in the budget or in other activities/entities of the government at the end of a fiscal year had to revert back to the general fund for inclusion in the next year's budget. When the laws were changed, governments could and can hold and invest these excess funds for "future use." So what governments did was to allocate/spend all budgeted items so that the public would think that there were no surpluses. In reality, many of the allocations (expenditures) were to funds/projects/programs that did not spend all of the funds allocated and excesses were allowed to accumulate.

For budget purposes revenues minus expenditures equals surplus (deficit). That is simple. However, when expenditures are to funds/projects/programs that do not need the money, this usually does not show up in the budget reports, but it does show up in the Comprehensive Annual Financial Report (CAFR). The CAFR must include all assets, liabilities, revenues, expenditures, etc., etc. It cannot be hidden. If the Facilities Improvement Fund receives $100 from the budget (expenditure for the budget process) and only spends $60, the $40 not needed is usually not included in the budget process as a surplus of funds, but is included in the CAFR as an asset, which is invested. If each year the Facilities Improvement Fund continues to receive $100 and spends less than that amount, the accumulative, plus interest, surpluses grow pretty fast. The budget shows no surpluses, but the CAFR shows an asset that has been invested.

What Should be Done With the Surpluses?

Alan Greenspan, Chairman of the Federal Reserve, Told Us: In his testimony to the Senate Humphrey-Hawkins Committee, Alan Greenspan, Chairman of the Federal Reserve, in late July 1999 gave us a clue on what he thought should be done when he stated: "I'm of the old fiscal school that you raise revenues for basic government purposes and if you don't have those purposes you give the money back or you don't tax it... My experience is that private rates of return are significantly higher than the governments rates of return." 

What did he say? 

If a government collects too much from the people, the government should give it back. It is better to let the private sector have the money than governments. This we will prove in this site beyond a reasonable doubt. Lawrence B. Lindsey, the current White House Economic Advisor and a Former Governor of the Federal Reserve, Told Us: 

An August 1999 article in the Wall Street Journal is entitled "Whose Surplus Is it, Anyway?" The article is written by Lawrence B. Lindsey. This article deals with the "BUDGET" surpluses, not the "CAFR SURPLUSES" in this site. 

However, this article has some interesting points to ponder. 

“... Some Washington politicians play word games instead of speaking forthrightly...At the same time, this arithmetic allows Washington to return (in the above scenario) 53 cents on the dollar of the higher revenue to the taxpayer and call it a "tax cut." "The convention behind these semantic acrobatics is the belief that the money belongs to Washington and that anything they let us taxpayers keep is a token of their beneficence." 

"Gone, then, are the notions that earnings belong to those who earned them and that government should take only what it needs to fund necessary services. This is a fiscal path that will gradually sap the vitality that has made our economic success possible...But when it comes to the on-budget surplus, the best way for Congress to 'spend' this reserve is not to spend it at all. It is to give it back -- in its entirety -- to the people who earned it in the first place." 

Although the above article deals with budget surpluses and not actual surpluses as will be shown in this site, the recommendation for both are the same “...give it back -- in its entirety ...†

Government Surpluses are the taking of the peoples property without the right to take: 

In a recent Wall Street Journal article, Mr. William P. Kucewicz, made in-depth observations and insights regarding the role of governments holding surpluses of the peoples money. We could never have said it as eloquently as he has: 

"...Almost no one seems to note that a surplus at any level of government represents money that would otherwise be used for consumption or investment by those who earned the income in the first place. And to the extent that it's squirreled away by government and isn't used, say, to retire debt, it's a drain on the economy. 

Also missing from the discussion is a basic question: Whose money is it, anyway? Government's moral legitimacy is derived from the people. This cornerstone of the classical liberal tradition presupposes that government's precursor is the individual, endowed with a natural liberty as a free moral agent ...

Although taxation is legitimate, running a government surplus isn't. It represents a taking by the state, because it exceeds the government's contract with the community. It is no different than if a federal agency were to take a person's land or possessions without just compensation (an activity barred by the Fifth Amendment). Excess taxation isn't what the people bargained for. Federal taxes nevertheless now absorb more than a fifth of gross domestic product -- the highest level since World War II - and the percentage is bound to rise, given the new revenue estimates. 

... When a government boasts of fiscal surpluses that stretch as far as the eye can see, it assumes a prerogative that supersedes the natural rights of the individual. In presuming entitlement or authority not ceded by the community, the state abrogates its moral pact with those it governs. The Local Economy Loses Out

When governments' retain surpluses and invest these funds in the type of investments governments are allowed to invest in, very little if any of the investments are in the local economy. As shown above and elsewhere on this site, many governments have investments in foreign companies and currencies. The greatest benefit for all Americans is when the money is invested in their local economy. This is the most important aspect of returning surpluses to the people. 

Determining the surpluses in State and Local Governments 

An individual does not have to be an accountant or know anything about accounting to determine the amount of surpluses that exist in a State or local government. All it takes is a little reading and time.

It is important to note that a complete review and the preparation of an economic impact analysis only takes 5 pieces of paper (forms in the computer program). In fact, if you do not like computers, then you can print out the blank forms. With the CAFR, the blank forms, the CAFR Review Guide, a pencil and calculator, the complete review and economic analysis can be accomplished. Naturally, the computer program makes it much easier because it does the computations automatically

In addition, in each of the 24 plus State and numerous local reports available contain the complete review of these governments. That is a lot of examples to learn from.

Conclusion: Get Out of the Box

Too many people are locked in a box and have difficulty thinking outside the box. This is because of programming by the news media, political correct enforcement, spin doctors and governments. We are asking you to think outside the box for a little while. Think of the total impact, not just one aspect of the impact.

Silent Majority Remains Silent

Remember what Alan Greenspan said (quoted earlier) about governments taking too much money. We also believe any surpluses should be returned to the people and let the people have the money in their investment portfolios. Remember (1) He who owns the gold rules and (2) He who writes the rules wins. Today, unfortunately it appears that governments, and a few super wealthy individuals that control the governments, own the gold, write the rules and probably will win -- while the silent majority (middle class), remains silent.

I AM POINTING OUT THESE THINGS BECAUSE ONCE PEOPLE HAVE MONEY, SOME OFTEN TEND TO ARROGANCE AND TAKING ON THE “SYSTEM” FOR WHATEVER REASON.

WORKING WITH WHAT WE HAVE IS THE CURRENT METHOD OF GETTING THINGS DONE, BUT HOW WE RECEIVE AND USE THE MONEY THAT IS COMING, IS A CRITICAL FACTOR. BANKS HAVE BEEN INVOLVED IN NEFARIOUS PRACTICES OF COURSE, THAT IS ALL THROUGH PUBLISHED HISTORY, AND A WINDFALL OF THIS NATURE ENTERING THE WORLD ECONOMIES IS EITHER A PAYDAY FOR THEM, OR REGULAR SOBERING FINANCIAL TRANSACTIONS WHERE THEY PROVIDE THE SERVICE AGREED UPON WITHOUT GIVING CONTROL OF YOUR MONEY. BANKS WOULD BECOME A FIDUCIARY RECEIVING FIXED FEES INSTEAD OF HAVING THE MONEY USED BY THEM IN ALL SORTS OF WAYS – YOU OF COURSE WOULD NOT SEE A DIME FROM THE PROFITS THEY WOULD GENERATE AND KEEP ON BUSINESS AS USUAL IN THE GLOBAL BANKING WORLD TO CONTINUE THE RAPE AND PILLAGE. THE BANKS HAVE TWO MAIN TYPES OF ACCOUNTS. CURRENT AND FIDUCIARY. IN THE CURRENT ACCOUNT, YOU SIGN PAGES OF RULES TO OPEN THE ACCOUNT. IN OPENING A FIDUCIARY ACCOUNT, YOU CAN SPELL OUT THE TERMS AND A PRICE FOR THESE SERVICES SINCE BANKS OFFER THIS SERVICE AS PART OF THE THEIR PORTFOLIO OF BANK PRODUCTS THEY SELL. THESE ARE TWO DIFFERENT THINGS AND MUST BE REALLY UNDERSTOOD WELL. IN ONE ACCOUNT, YOU TURN OVER YOUR MONEY TO THE BANK AND IT BECOMES THEIR MONEY. IN THE OTHER, THEY LOOK AFTER THE MONEY BUT IT IS NOT THEIRS.

THE WEALTH MANAGEMENT SECTOR OF THE BANKS WILL BE OF GREAT HELP IN THESE MATTERS WHEN THE TIME COMES AS THEY DO HAVE GOOD EXPERIENCE IN GIVING GOOD ADVICE AND SERVICES TO THE CLIENT. I AM GOING TO TAKE ADVANTAGE OF THESE SERVICES MYSELF.

Preamble

  • The purpose of the prosperity funds and the opportunity to create resources from currencies is to make up in some small part for past abuses by banks, to signal and to implement a paradigm-shift in world finance and prosperity, which must fundamentally include how banking is done and the contractual terms under which it is done.
  • It is understood that they owe each and every one of us “privately”, so reform must be driven by each and every one of us — also privately, one on one — by maturing to this aspect and holding banks accountable to acknowledge who we are in this transaction.
  • Note that both the deposit you are making, and the funds under consideration, are yours, not the bank’s. The bank does not get to set the terms by which you access your money. Nor do they get to use your money without your permission – see Use of Funds, later in this document.

 

Terms of Exchange

  • Terms: In general, you must use exacting contractual terms that no longer facilitate commercial fraud and embezzlement. You must ensure all these points are covered in whatever agreement you come to.
  • Ownership: All funds deposited, transferred within or transferred out of your accounts must be denominated as lawful money under private civilian ownership;
  • Deposit Nomenclature: This is a “Private Civilian Special Deposit” and you must ensure banks are do not presume otherwise. In other words, all deposits associated with you and your NAME must be considered Private Civilian Special Deposits by the bank, meaning that the bank acts as a Fiduciary Trustee, with no ownership interest implied or expressed with respect to the assets deposited.
  • Withdrawal: As such, the bank must acknowledge and honor that you retain the right to withdraw your funds at any time in part or in full, absent any other agreement under Use of Funds, below.
  • Access: This also means there must be explicit agreement that you will enjoy unrestricted access to your accounts and assets in the normal course of business and that you will not be subjected to regulatory controls and requirements that apply to the bank and its officers or considered a shareholder or surety absent your fully disclosed and willing participation in specific Joint Ventures or Investments as described in Use of Funds below.
  • Safe-keeping receipts (SKR’s) must be issued for all primary deposits and proceeds derived from prosperity funds and currency exchanges, and must be routinely updated and presented to you, the Primary Creditor, every thirty (30) days in writing. This is a function of the bank and is a normal procedure as a Fiduciary.
  • Priority Creditor: As the depositor you are not acting in the capacity of a donor and are defined explicitly and permanently as the “Creditor of First Recourse”, otherwise known as the “Priority Creditor” having first right of claim and first right of redemption on all assets of the bank in the event of any disaster, bankruptcy, adversarial merger, regulatory change, legal judgment or other adverse circumstance affecting the bank.
  • Safe-Keeping Clause (distinct from SKRs) requiring the bank to move all funds to safety in the event of any threat of confiscation, lien, or diminishment of your assets or your exclusive ownership interest in those assets.
  • Fees: The banks deserve a fee for managing your funds, but definitely not a percentage of the capital and certainly no controlling or ownership interest at all. Fees are straightforward for performing fiduciary services.
  • Confidentiality: Bank to maintain fiduciary confidentially in all regards and contract terms must include a Non-Disclosure,Non-Competition, and Non-Circumvention agreement, but this must not restrict your ability to discuss the contract with anyone you choose. The bank is a service provider, not an equal or partner.
  • Maintaining records: Bank to provide monthly statements on all accounts including but not limited to: escrow accounts, special purpose accounts, or Joint Venture / management agreements, and all other functions that affect or cause change to your funds. Normal banking practice.
  • Access to Accounts: Clearly stating which officers of the bank staff can access your confidential bank account details and requiring the bank to maintain fiduciary confidentially in all regards. Clearly state “This account is to be marked “NON-TRAINING” and “NOT-ONLINE”.
  • Consequences: There must be clearly stipulated consequences, remedies and/or pre-agreed upon penalties for each and every breach of your Depositor’s Agreement including return of all principal and interest, plus a penalty of three times (3X) the total of your losses, if any. This is a negotiable matter.

Use of Funds

  • This agreement must clearly spell out what the bank can and cannot do with all proceeds of your accounts.
  • Specifically, they may not use your funds for any purpose without getting your explicit, fully disclosed and voluntary approval in writing first.
  • Must provide you with regular scheduled accounting every month and promptly provide SKR’s in exchange for appropriate regularly billed and agreed upon service fees.
  • May not use your funds as collateral for any form of surety, which means that as the depositor you demand complete disclosure and transparency prohibiting the bank from hypothecating debt against your assets or leveraging your deposits for any reason or purpose not specifically presented to you in writing prior to any action being taken by the bank, which must be in the form of a written “Request for Use of Funds” subject to your written agreement.
  • Requesting Use of Funds will include:

·        Presentation of formal proposed contracts to you as Priority Creditor detailing any and all proposed use of your assets by the bank, together with clearly stated terms of participation, and if you decide to participate, clear and complete description of the guarantees, risks, and standing you will have within the context of that particular Joint Venture or Investment Opportunity;

·        Clearly stipulated exit procedures for all Joint Ventures and Investments with the bank or in cooperation with the bank;

·        The bank does deserve something for implementing your instructions as to how the capital may be invested, perhaps a tiny percentage of the growth/profit (not capital) would be appropriate — a consideration that must be made on a case by case, offer by offer basis.

We often feel that we don't have the time or energy to extend ourselves to others with the small gestures that compose what we call common courtesy. It sometimes seems that this kind of social awareness belongs to the past, to smaller towns and slower times. Yet, when someone extends this kind of courtesy to us, we always feel touched. Someone who lends a helping hand when we are struggling with our groceries makes an impression because many people just walk right by. Even someone who simply makes the effort to look us in the eye, smile, and greet us properly when entering a room stands out of the crowd. It seems these people carry with them the elegance and grace of another time, and we are always thankful for our contact with them. Common courtesy is a small gesture that makes a big difference.

 

An essential component of common courtesy is awareness and common sense--looking outside yourself to see when someone needs help or acknowledgment. As a courteous person, you are aware that you are walking into a room full of people or that your waiter has arrived to take your order. Then, awareness leads to action. It is usually quite clear what needs to be done--open the door for the woman holding the baby, move your car up two feet so another person can park behind you, acknowledge your sister's shy boyfriend with a smile and some conversation, apologize if you bump into someone. A third component is to give courtesy freely, without expecting anything in return. People may not even take notice, much less return the kindness, but you can take heart in the fact that you are creating the kind of world you want to live in with your actions.

 

When you are out in the world, remember to be aware of others, lend your hand when one is needed, and give this help without an ulterior motive. Through these small actions, you make this world a better place in which to live.
