Here are the Upcoming Supreme Court Cases About Gun Control You Need to Know About

  • Two upcoming Supreme Court cases are about the Second Amendment and might change everything we know about guns in America. One is in New York and is centered around the transportation of firearms and ammunition.

    The other is about gun manufactures and litigation that they might face in the wake of a shooting. Depending on how either goes we might see a reshaping of the Second Amendment and how we think about it. Here are the court cases and their potential outcomes:

    1.) New York State Rifle and Pistol Association v. City of New York

    The NYSRPA is fighting the City of New York over the transportation of guns. A new law in the city prevents the transportation of a firearm outside the home unless the gun is unloaded and away from ammunition that would be used with the firearm.

    The NYSRPA's argument is that the law violates the right to self-defense by rendering firearms practically unusable in a scenario where they might be needed.

    Depending on how the Court rules, in this case, the Second Amendment might be critically undermined and guns might be unable to leave their owners' homes – or the Second Amendment might be bolstered in liberal jurisdictions.

    3.) The Temperament of the Court

    Based on the current composition of the court, the case may be a shoo-in for the Second Amendment.

    The court has a conservative majority but some of the conservative justices might be soft on gun rights and the case may be thrown out altogether leaving this question unanswered.

    4.) Remington Arms Co. v. Soto

    The second case affecting the Second Amendment is between America's oldest gunmaker – Remington and the victims of the Sandy Hook Elementary School shooting. Although gun manufacturers are protected by law, a Connecticut high court's ruling pushed back on them and now the case is moving on to the Supreme Court.

    5.) The Future Ruling

    The outcome of this case may end the Second Amendment as we know it or it may create a sense of peace for the firearms and ammunition industry. If the high court rules in favor of Soto, the anti-gun lobby will sue gun manufactures over every shooting that takes place. That reality would push many, many companies under. With such grave consequences, this is the more important of the two cases.

    6.) The Possibility of a Soto Victory

    The possibility of Remington losing this case is low. Precedent, common sense, and a conservative majority are on their side but the thought of this case even being brought up to the Supreme Court is chilling due to the possible ramifications.
