OK, it wasn’t Barack Obama that made the announcement, but it was the guy riding “shotgun” with him (pun intended). The Obama administration announced two new gun control measures via Vice President Joe Biden on Thursday morning. Adding to the 23 previous executive orders that Barack Obama issued back in January, he issued two more that in his words will “keep the most dangerous firearms out of the wrong hands and ban almost all re-imports of military surplus firearms to private entities.”

The announcement came as the new Alcohol, Tobacco, and Firearms (ATF) director Todd B. Jones was sworn in.

While the Obama administration calls these “common-sense” proposals, they are actually unconstitutional proposals as we have cited before.

First, the administration wants to close a loophole. Under current law machine guns and short-barreled shotguns must be registered (something that, again, is unconstitutional). While the press statement only points to the fact that in order to possess one of these legally, one must have a fingerprint-based background check, they fail to tell you that it also incurs a hefty fee, in addition to purchasing the weapon.

Now comes the reasoning.

“However, felons, domestic abusers, and others prohibited from having guns can easily evade the required background check and gain access to machine guns or other particularly dangerous weapons by registering the weapon to a trust or corporation. At present, when the weapon is registered to a trust or corporation, no background check is run. ATF reports that last year alone, it received more than 39,000 requests for transfers of these restricted firearms to trusts or corporations.”

Now wait a minute! Since when have we heard of criminals turning up with weapons that have been registered to trusts and corporations? Don’t get me wrong, I’m sure there are a lot of Mr. Obama’s friends who might fall into that category along with several big banks, but seriously, this is not an issue.

Furthermore, can we honestly trust the ATF on anything? These were the guys who knowingly participated in walking guns illegally over our southern border into the hands of known criminal cartels! The agency is the one not performing the job of prosecuting those breaking the illegal laws in the first place!

So what are they doing to close the loophole? According to the press statement:

“The proposed rule requires individuals associated with trusts or corporations that acquire these types of weapons to undergo background checks, just as these individuals would if the weapons were registered to them individually. By closing this loophole, the regulation will ensure that machine guns and other particularly dangerous weapons do not end up in the wrong hands.”

So wait, where is Congress on this? Why are they not calling out the Obama administration over this issue? Congress makes law, not the Executive Branch. The language of “dangerous weapons” is purposefully vague. I mean we already know more people die from hands, feet and hammers than guns. I don’t see a loophole being close for people to possess those.

The second of the executive orders taken involves surplus military weapons. When the United States provides military firearms to its allies, either as direct commercial sales or through the foreign military sales or military assistance programs, those firearms may not be imported back into the United States without U.S. government approval. Since 2005, the U.S. Government has authorized requests to reimport more than 250,000 of these firearms.

Today, the Administration is announcing a new policy of denying requests to bring military-grade firearms back into the United States to private entities, with only a few exceptions such as for museums.

According to the administration, “This new policy will help keep military-grade firearms off our streets.” I’ll add the obvious here,

“Except for law enforcement, government officials and military.”

This measure would keep such weapons as those which are over 50 years old! These weapons include such firearms as the M1 Garand. You can find a list of these “curios or relic” firearms here.

The National Rifle Association, ripped the administration, saying “The Obama administration has once again completely missed the mark when it comes to stopping violent crime.”

“Requiring background checks for corporations and trusts does not keep firearms out of the hands of criminals. Prohibiting the re-importation of firearms into the U.S. that were manufactured 50 or more years ago does not keep firearms out of the hands of criminals. This administration should get serious about prosecuting violent criminals who misuse guns and stop focusing its efforts on law-abiding gun owners,” the NRA said in a statement.

If you aren’t awake yet, you should be. This is all about removing our ability to defend against tyranny. I’ve said it before, and I’ll say it again. Military-grade weapons should be in the hands of the citizens just as much as in the hand of the military! That is the purpose of the Second Amendment. It was to ensure that we had equal weapons in order to secure a free state from tyranny, such as the current regime residing in Washington.
