FORMER FED PROSECUTOR: POTUS TRUMP HAS THE POWER TO 'STOP ALL IMMIGRATION'

(National SentinelBorder showdown: Former federal prosecutor Sydney Powell told Breitbart News Radio on Wednesday that POTUS Donald Trump already has all the authority he needs to “stop all immigration” as thousands of people in two migrant caravans continue to make their way to the U.S. from Central America.

 

“It’s under 8 United States Code Section 1182 F,” she said. “It derives from the very clear language of the statute that says he can make a finding that it is in the national interest — it doesn’t even say national security; it just says in the national interest — to halt all immigration for any aliens, and that means any and all.”

8 U.S. Code § 1182, entitled “Inadmissible aliens,” says:

Suspension of entry or imposition of restrictions by President

Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate. Whenever the Attorney General finds that a commercial airline has failed to comply with regulations of the Attorney General relating to requirements of airlines for the detection of fraudulent documents used by passengers traveling to the United States (including the training of personnel in such detection), the Attorney General may suspend the entry of some or all aliens transported to the United States by such airline.

 

Powell went onto note that in a 5-4 decision, the U.S. Supreme Court has recognized and upheld the president’s power under the law.

“That particular wording in the statute was also recently discussed and affirmed in the Trump vs. Hawaii — quote travel ban — case,” said Powell, Breitbart News reported.

 

“This would be a plain application of the text of the statute as already affirmed by the Supreme Court, which recognizes the absolutely broad power that the president has to do this. That would cut out any claims of asylum or anything else; it would just stop all immigration except for people who are already on an approved list, who have gone through the lawful process already and are pending approval, but it would stop any and all new immigration whatsoever.”

 

Host Rebecca Mansour asked if that included the authority to shut down the border completely.

“Essentially, yes. You wouldn’t necessarily have to seal it off physically, but that means that anybody that came in after the date of that executive order would be here illegally.”

Powell also said the president does not need any additional authority from Congress because he’s already gotten it in the form of the previous statutes.
