On Wednesday 11th May 2011, in the United States District Court of Utah (Case 2:08-CV-0788-CW-SA Document 82 Filed 05/13/11) under Judge Clark Waddoups, the United States Central Intelligence Agency argued that it had the authority to deliberately mislead the court.
The hearing learned that on four separate occasions in 2009, 2010 and 2011, David M Hardy of the CIA had provided false and misleading information to the court through sworn statements. When the deception was revealed, the US Government argued that it had the authority to mislead the court if it wished.
Under consideration was the case of the Islamic Shura Council of Southern California v. Federal Bureau of Investigation (No.SACV07-1088-CJC, 2011 WL 1576476 S.D.Cal April 27, 2011).
