Background checks have always been a part of the immigration process, but since the 9/11 terrorist attacks, America — as well as countries all over the world — has paid more attention to people crossing the borders. A background check is an important part of the immigration process that every potential US immigrant must go through. Immigration background checks are performed on every applicant, regardless of ethnicity, national origin or any other factor.

Security and the law: No Background Check for Guard Becomes Key in Lawsuit

In a recent case in the state of Illinois, a woman who was sexually assaulted filed a lawsuit against the security service that employed the rapist and the apartment building manager that engaged the service. She claimed, among other things, that the failure of the security service company to perform a background check had proximately caused the attack on her. The lower court granted a summary judgment in favor of the security guard company and the plaintiff appealed. The victim had been a house guest of apartment house tenants. In fact, she had been assisted by the rapist earlier on the day of the attack, in his capacity as a security guard.

How Far Back Will a Company Background Check Go?

A company background check refers to an employment background check conducted by the company, or employer. As a rule, background checks go back five to 10 years in an applicant's history. An employer may, however, wish to go back further for employment, driver's or education histories. States have regulations on how far back a company may research criminal records, typically seven years, as well as which kind of records are reportable.
